ELEMENTAL COOKING IMMERSION TERMS & CONDITIONS. 

I confirm and agree that the following terms and conditions and undertakings apply to the activities to be offered to me by Cade McConnell.

1. I have been examined by a licensed medical practitioner (“Practitioner”) within the past six months and have been found by such Practitioner able to perform Yoga and all types of movement including but not limited to breathwork, walking, swimming, which I am to perform during my cooking immersion with Cade McConnell.

2. I will follow all instructions given to me by Cade McConnell and his assistants as to when, where, and how to perform and not to perform the Activities.

3. I agree and acknowledge that participation in any of the Activities could constitute a risk of serious injury to myself, including permanent paralysis or death. I voluntarily and knowingly recognise, accept and assume this risk and warrant that I am physically fit and able to perform the Activities without risking serious injury, including permanent paralysis or death. I acknowledge that neither Cade McConnell or employees and contractors or assistants be, nor be deemed to be responsible or liable (whether in contract or in tort or under any statute whatsoever), for any injury, illness or other mishaps I sustain arising from or out of, or in any way directly or indirectly connected with the Activities.

4. I understand and acknowledge that I am to receive instruction and facilitation in Activities and that Cade McConnell and his assistants are not liable for, nor expected to provide any advice, training or medical assistance other than in the direct instructions of cooking.

5. I indemnify and will at all times hereafter well and sufficiently indemnify and keep fully indemnified Cade McConnell and his assistants from and against all actions, suits, causes of action, proceedings, claims, costs and expenses whatsoever which may be taken or made against Cade McConnell and his assistants, incurred or become payable by Cade McConnell, in connection with or arising out of any such injury, illness or mishap to me on the cooking immersion with Cade McConnell.

6. The 50 % deposit and any other payments paid by me under this enrolment form and as per the conditions indicated by email and on the OM CADE website are not refundable.

7. Cade McConnell at all times up to and including the first day of the retreat has as its sole and unfettered discretion the choice to terminate this contract on the basis that not enough people or customers have booked or arrived at the immersion. Whether or not enough people/customers have attended any retreat will be decided by Cade McConnell in its sole, absolute and unfettered discretion. If Cade McConnell terminates this contract for the reasons outlined above then Cade McConnell, he will offer a full refund of the expenses paid.
